Wyeth Loses Prempro Trial, Must Pay $3M

A Philadelphia jury decided that the hormone replacement treatment helped cause an Ohio woman’s breast cancer and, after deliberating two days, decided that Wyeth “failed to provide an adequate warning” to Jennie Nelson.

The award includes $2.4 million in compensatory damages for Nelson, 67, and $600,000 for her husband. The case has been hard fought: an October verdict in her favor was thrown out and, in this trial, the judge ruled out punitive damages.

“We respectfully disagree that there is any scientific basis to support the jury’s finding of a causal link between Wyeth’s hormone therapies and the plaintiff’s breast cancer,” said Barbara Binis, a lawyer at Reed Smith, which represents Wyeth, in a statement. She added that Wyeth acted responsibly.

“The evidence presented at trial revealed that Wyeth has known for decades that postmenopausal hormone therapy causes breast cancer but that Wyeth chose to avoid testing this dangerous hormone combination and delayed stronger warnings for fear of flagging sales,” said Nelson’s lawyer, Tobias Millrood, in a statement.

Wyeth has now lost three out of five Prempro trials, and there are nearly 5,000 lawsuits stacked up in courts around the country.

So Wyeth’s public relations apparatus is beside itself trying to play down the loss. Today’s press release says: “Philadelphia Hormone Therapy Trial Completed.” But when Wyeth won last month, the press release crowed “Wyeth Wins Little Rock Hormone Therapy Trial.”

Does Wyeth’s pr team really think no one will notice?
