A Wyeth Prempro Loss Is Overturned

gavel.jpgA Pennsyvlania state judge has overturned a Prempro verdict that Wyeth lost in February. In that case, a Philadelphia jury decided that Wyeth’s hormone replacement therapy caused a woman to develop breast cancer, and awarded her and her husband $3 million in damages. The drugmaker immediately announced it would appeal.

That decision was actually the second time a jury found in favor of the plaintiff, Jennie Nelson. In a first trial last October, a jury at the Philadelphia Court of Common Pleas awarded the couple $1.5 million in compensatory damages, but judge threw out that verdict and declared a mistrial, leading to the retrial. There was never any official explanation for the mistrial, although reports at the time suggested juror misconduct.

So it now appears that Wyeth has won four of six Prempro trials (if our math is faulty, please write in). The game has only just begun, but this sort of track record is exactly what Wall Street likes to see - a clear trend that suggests a drugmaker can tough it out in court. Then again, there are still 4,000 or more suits stacked up.

  1. You had better get up to date and get the calculator out because your figures are way off. I am a woman that took prempro for 10 years, have breast cancer that my oncologist told me was caused by prempro - the pathology report in some way confirms this. May Wyeth and Pfizer go straight to hell. They should take responsibility for their horrible mistake and settle. Our lives have been drastically changed due to their stupidity. Do you know what ingredients are in prempro - if you knew, you wouldn’t take it. We all trusted out doctors and they were wrong because the drug maker was out for the almighty buck!

  2. Furthermore, who the hell is this judge to rule the drug companies should not be held to punitive damages. If there is any case that there should be punitive damages, it is this one. How would you like it if your wife, mother, daughter had breast cancer due to a simple pill!
