Fen-Phen Family Scam Ends In Guilty Plea

A 68-year-old San Antonio woman and her two children pleaded guilty to a single count of mail fraud conspiracy for falsely submitting claims to a settlement trust overseeing the fen-phen diet-pill litigation. In particular, Vernon Barnett fabricated labels for prescription pill bottles that indicated the scrip was written for Redux, a chemical cousin of one of the fen-phen pills that was also withdrawn, in 1989.
But Vernon, 44, didn’t do his homework. Redux wasn’t available until 1996. And the phony scrips were supposedly filled at a pharmacy at a location where a pharmacy didn’t exist, according to US Attorney Pat Meehan in Philadelphia. The family, each of whom faces up to 18 months in jail, admitted their goal was to cash in on the fen-phen claims being paid by the trust set up for people with legitimate claims.
