The Roche Stress Toy: For Anemic Court Battles

Depending on one’s view, this little stress ball either resembles a drop of blood or a teardrop. The drugmaker, you may recall, did shed a tear last month when a federal jury in Boston ruled that its Mircera anemia med infringed on patents for Amgen’s Aranesp and Epogen treatments. Roche intends to appeal the decision, but the delay will cost the drugmaker a year or more before Mircera is available. To cope, Severin Schwan, who succeeds Franz Humer as ceo in March, may need the stress balls Roche was handing out to docs. Of course, everyone loses a patent fight now and then. Perhaps Franz can direct the marketing team to sell these to lawyers and recoup some of the Mircera investment.
