Nobody should have any doubt that the commercial management at Bayer Consumer knew exactly what they were doing - an end run around the system. They were probably told by their regulatory, legal and medical staff that this was not allowed, but they did it anyway. In 2008, the top management at Big pharma simply ignores what they don't want to hear, fires the employees that dared to raise the questions, and does what they intended in the first place. besides, if they ever get caught, they deny any wrongdoing, the company pays a fine, and they laugh all the way to the bank. It's the Big Pharma way!

This is "off-label" selling to the max wouldn't you say?

The interesting thing, is that this drug made it all the way to the shelves on the store without anyone at Bayer thinking it needed to run it by the FDA?

A warning letter, are you kidding me?

“The marketing of these unapproved drugs is troubling,”

Yet, the commercials are still on the air.

The FDA should reconsider its approval of the health claim for phytosterols (aka plant sterols). Phytosterol supplements lower LDL but have never been shown to prevent heart attacks and strokes.

It seems that Bayer has been pushing the envelope and now has to deal with the attention it has drawn to itself. I have seen these commercials for months and wondered how long it would be before the FDA caught up with them. They know the rules and appear to have chosen to ignore them. These companies do it to simply sell more product, figuring that they'll make more money than the fine will be. Hence, net profit. One might expect this from a fly-by-night nutrceutical firm, but not a company like Bayer that also markets ethical pharmaceuticals.
