Lilly Pays $45M To Settle Zyprexa Suit With So. Carolina

Though most of the press coverage to date has been on state and federal litigation, I wonder if persons with schizophrenia, dementia and children with standing are actually suing Eli Lilly in any relationship to the number having standing.

Nationally it has been estimated that 80,000 individuals have sued Eli Lilly over Zyprexa yet the South Carolina AG estimated that in his state alone 64,000 were were affected by this medication. Moreover, Vioxx settlements with individuals came to almost $5 billion yet to date individual settlements for Zyprexa have been only $1.2 billion.

Did Eli Lilly get a break when it came to the number of individual litigants because of the nature of the class of prescribees injured by Zyprexa? Was this class disinclined, unable, and/or unaware of their right to to sue in the world's most litigious nation?
